PTAB Denies Two More Symantec Petitions for IPR of Finjan Patents

The Patent Trial and Appeal Board (PTAB) has rejected two petitions for inter partes review (IPR) filed by Symantec against two Finjan patents (7,613,926; 8,677,494), following the January denial of six other petitions filed by the company. In the two challenges most recently denied (IPR2015-01895, IPR2015-01897), Symantec had sought to invalidate various claims in the targeted patents under both §102 and §103, arguing that prior art rendered the ‘926 patent obvious and that the ‘494 patent was both obvious and anticipated. However, for each petition, the Board ruled on February 26 that Symantec had failed to show that it had a reasonable likelihood of prevailing with any of its asserted grounds for invalidity, and thus had not met the threshold for institution. The day prior, the PTAB also denied three of Symantec’s requests for rehearing of its earlier IPRs (IPR2015-01545, IPR2015-01546, IPR2015-01547).
