Judge Stark Declines to Overturn $8M Symantec Infringement Verdict in IV Antivirus Suit

Symantec has hit a snag in its attempt to overturn a Delaware jury’s finding that it infringed an antivirus patent (5,987,610) asserted by Intellectual Ventures I LLC (IV) (1:10-cv-01067). In an order filed on March 10, 2016, District Court Judge Leonard P. Stark denied Symantec’s motion for judgment as a matter of law (JMOL), which sought to overturn a February 2015 verdict that the company had infringed claim 7 of the ‘610 patent. The motion also challenged the jury’s decision that Symantec had not shown that the challenged claim was invalid. On the issue of infringement, Judge Stark held that “substantial evidence supports the jury’s finding that Symantec performs all the steps of claim 7”. He further concluded that “Symantec did not present clear and convincing evidence that claim 7 of the ’610 patent is either anticipated or obvious”.
