National Association of REALTORS Seeks to Invalidate Database Patent by IPR and in District Court

June 8, 2016

The National Association of REALTORS (NAR) has filed a complaint (2:16-cv-00851) seeking a declaratory judgment that the patent (6,529,908) asserted by Data Distribution Technologies LLC in a campaign is invalid for seeking to claim abstract ideas and for doing so by claiming functions without sufficiently disclosed structures to perform them. NAR bases jurisdiction on cases filed against real estate brokerages Prudential (1:12-cv-04878), RE/MAX (1:12-cv-04877), and Weichert (1:12-cv-04149), as well as on alleged threats made against additional brokers, including at least one broker in Washington state.
