ESET Added to Finjan’s Antivirus Campaign, Fires Back with Declaratory Judgment Action

Finjan, Inc. has added ESET to its computer security campaign (3:16-cv-03731), accusing the software company on July 1 of infringing six patents (6,154,844; 6,804,780; 7,975,305; 8,079,086; 9,189,621; 9,219,755) generally related to anti-malware technology. That same day, the NPE also sued ESET in the German District Court of Dusseldorf, asserting a European patent (EP 0 965 094) with similar subject matter. ESET fired back with a declaratory judgment action (3:16-cv-01704) also filed on July 1, seeking a judgment that its products do not infringe the ‘305 patent. These new lawsuits are the latest development in a campaign that has stretched over a decade and has included multiple settlements, trials, and unsuccessful attempts to invalidate the asserted patents.
