Intel Hits Fortress with Antitrust Suit Alleging Anticompetitive Patent Aggregation

November 4, 2019

Late October saw Intel file suit (3:19-cv-06856) against Fortress Investment Group LLC, along with several entities that it says Fortress owns or controls, accusing the investment firm of stifling competition through the acquisition and “endless, meritless litigation” of “weak patents”. Fortress’s allegedly anticompetitive aggregation scheme imposes “a tax on the electronics industry that increases prices, decreases output, and ultimately harms consumers”, said Intel in its October 21 complaint.

Tapping RPX strategic intelligence and data analytics, this article provides a deep dive into Fortress’s patent aggregation practices and serial litigation. It also surveys the effective use of inter partes reviews by defendants in the many campaigns launched over patents once held by Uniloc Corporation Pty. Limited.
