SMS Link Campaign Continues to Grow in California

Hypertext Technologies LLC has expanded its sole litigation campaign, launched earlier this month, with two new suits filed against Apple (8:19-cv-02404) and Yulong Computer Communications (Coolpad Technologies) (8:19-cv-02365), both in the Central District of California. The single asserted patent, a former Pantech asset, generally relates to jumping from a text message containing a URL to the corresponding website. Both defendants are accused of infringement through the provision of smartphones capable of opening URL links embedded into SMS text messages.

Hypertext began its campaign on December 6 with a pair of suits filed in the same district against Alphabet (Google) and BBK Electronics (One Plus), targeting mobile devices allegedly offering similar features related to SMS embedded links. Registration documents filed in California for Hypertext, a Delaware entity, indicate that the plaintiff shares an address and suite number with Cellular Evolution LLC, another NPE that acquired the patent now asserted by Hypertext (7,113,801) along with five other Pantech patents in May, asserting those additional five patents in a campaign of its own that still remains active. Cellular Evolution assigned the ‘801 patent to Hypertext in late August. Both Hypertext and Cellular Evolution share an address with California law firm Farjami & Farjami. Farshad Farjami, one of the firm’s founding partners, is also the registered agent for Hypertext and signed the NPE’s California incorporation filing.
