Defendants Prevail in Appeal by Acacia Subsidiary

June 10, 2011-  The Federal Circuit has affirmed a lower court’s 2010 ruling of noninfringement by Apple, Intel, Motorola, Numonyx, and Sony Ericsson in a suit brought by Acacia Technologies subsidiary, Fast Memory Erase (FME).  FME originally filed suit against the defendants in 2008, alleging infringement of two semiconductor patents that Acacia acquired in 2007 from Alliance Semiconductor.  The 2010 final judgment of noninfringement by the Texas court determined that the defendants’ accused NOR Flash products could not be proven to infringe the required “source leakage” claim elements as construed by the court.
