Uniloc Loses Bid to Reinstate $388M Award

May 17, 2011-  The US Federal Circuit Court of Appeals yesterday denied Uniloc‘s [NPE] appeal to reinstate a lower court’s award of $388 million to Uniloc against Microsoft.  In January, the appeals court overturned a lower court’s decision to overturn an infringement verdict against Uniloc but ordered a new trial on damages, finding the methodolgy for calculating reasonable royalty was  flawed.  The $388 million award, one of the largest in history, was based on an entire market value calculation for all Microsoft XP and Word products with an activation feature.
