Eclipse IP Sues Callaway Golf Company

Eclipse IP filed suit against Callaway Golf Company, alleging that Callaway’s electronic ordering system infringes five patents related to computer-based notification systems.  Eclipse IP has filed over 15 prior suits since May 2011 against 1st in Video-Music World, AldoAmerica Honda Motor CompanyBrickhouse ElectronicsCydeaDick’s Sporting GoodsFootlocker.comHautelookJP Boden USAKellwood Company, MeetMoi, Nespresso USA, Nissan, Provide Commerce, Steve Madden, and Zulily. Eclipse IP was subject to one action for declaratory judgment brought by UPS in January 2011.  The patents-in-suit were assigned by the inventor, Scott A. Hortstemeyer, to Martin Kelly Jones of ArrivalStar before being assigned to Eclipse IP.  Scott A. Horstemeyer is reportedly a partner/attorney at the IP law firm, Thomas Kayden Horstemeyer & Risley LLP.  10/26, Western District of Kentucky, assigned to Judge John G. Heyburn II, 3:2012cv00707.
