Pinc Solutions filed a complaint for declaratory judgment against Mobile Logistics [NPE], seeking declaration that its real-time yard visibility and management product infringes a patent related to a trailer communication system. Mobile Logistics has filed over 30 prior suits since July 2012 against Americold Logistics, Costco Wholesale, Cost Plus, Dimension Trucking Services, Excel, FedEx, H.F. Campbell & Son, J.B. Hunt Transport, Kraft Foods Global, Kimberly-Clark, Knight Transportation, Marten Transport, Nestle USA, Old Dominion Freight Line, Prime, Schenker, Shaw Industries, SuperValu, Transfreight, and Tyco Electronics. According to the complaint, in the last four months Mobile Logistics has initiated 25 lawsuits against companies that use Pinc’s real-time yard visibility and management product, Yard Hound. Pinc Solutions added that at least 14 of these suits against trucking companies that only use Pinc’s RFID tags have been dismissed without prejudice and that Pinc has approached its customers to offer to indemnify and defend them from the Mobile Logistics lawsuits.
