In the past few years of persistently low interest rates, litigation finance has been picking up steam, touting high returns and record fundraising as well as growing adoption—including by patent plaintiffs. Now, amid the COVID-19 recession, the industry appears to be reaching new heights in the US, with no shortage of supply (in the form of capital from wealthy investors) or demand (from plaintiffs and also from law firms). As this evolution continues, the potentially profound effects of litigation finance on the patent space are becoming more apparent.
