Cronos Technologies [NPE] filed two separate suits against Abercrombie & Fitch, and Vitacost.com, alleging that the defendants’ websites infringe a patent related to a remote ordering system.  Cronos has filed nine prior suits since April 2012 against Camping World, Carter’s, Fossil, General Nutrition Centers, J. Crew, Nutrisystem, Tempur-Pedic, Toys“R”US, and Vitamin Shoppe. RPX reviewed the patent-in-suit on the open market twice, once in October 2009 (UBS) and again in November 2010 (UBS 2).  The patent-in-suit was issued to Highpoint Systems in September 1997, which later sold the patent to UBS AG in January 2006.  UBS AG assigned it to Cronos in September 2011.  8/31, District of Delaware, no judge yet assigned, 1:2012cv01092; 1:2012cv01093.
