New NPE Sues Lake Pointe Operating Company

Qxzab [NPE] filed suit against Lake Pointe Operating Company, alleging that Lake Pointe’s computer readable card for storing and managing a patient’s medical history infringes a patent related to storing medical histories using a smartcard.  This is the first patent infringement suit initiated by Qxzab.  The patent-in-suit was assigned by Stuart Bowie to Information Retrieval Acquisition in March 2012 and transferred to Qxzab along with one additional US patent (5,659,741) in August 2012.  Mark Baerwaldt is the named correspondent on the assignment from Information Retrieval Acquisition and the correspondent on the assignment in the Quxuz suit; however, the relationship between these two entities is currently unknown.  Although Qxzab has only asserted the 5,832,488 patent, RPX reviewed both patents as an open market opportunity (OT ICAP Spring 10 Lot Q-Bowie-Acq) in March 2010.  8/17, Eastern District of Texas, no judge yet assigned, 2:2012cv00491.
