Inventor Sues Attorneys for Negligence after Invalidation of Patent in 2000 Suit against NASDAQ

January 24, 2011- An individual inventor, Vernon Minton, filed suit against his legal representatives for negligence claiming that they failed to apply the experimental use defense to ovecome the on sale bar that was used to invalidate the inventor’s patent in a 2000 suit against NASDAQ and the National Association of Securities Dealers. According to the complaint, ”Plaintiff is an inventor. On January 11, 2000, U.S. Patent number 6,014,643 (the “643 Patent”) was issued to Plaintiff. The claims of the 643 Patent relate to a method and network for trading securities. The method generally requires that orders to purchase securities and orders to sell securities are gathered and transmitted over a public communications network to a data processing network where the orders are listed by price and quantity and the orders are displayed to individuals on a graphical interface.”  Defendants claimed that the inventor had offered the patented system for sale in the mid 199os. Civil Action No. 6:12-cv-00029.
