Diebold Files for DJ against NPE

Diebold filed an action for declaratory judgment against PPS Data [NPE], seeking declaration that Diebold’s ImageWay products and services do not infringe five patents related to software used to capture deposit information and images of the monetary items at financial institutions or remotely.  PPS Data has filed six prior suits since March 2011 including one against Diebold filed on January 5, 2012.  The patents-in-suit originated with NetDeposit, a bank software provider which changed its name to PPS Data in October 2010.  PPS Data is a subsidiary of Zions Bancorporation.  1/6, Northern District of Ohio, 5:2012cv00040.
