The JM Smucker Company Files for DJ against Lodsys

The JM Smucker Company filed an action for declaratory judgment against Lodsys [NPE], seeking declaration that its website’s “Online Store Questions” form does not infringe four patents related to a customer-based product design module.  According to the complaint, Lodsys sent Smuckers claim charts purportedly demonstrating Smuckers’ alleged infringement and encourages Smuckers to take a license.  Since February 2011, Lodsys has filed four patent infringement suits, and has been subject to 11 prior actions for declaratory judgment.   1/4, Eastern District of Wisconsin, 2:2012cv00012.
