Helferich Patent Licensing Sues Retailer over Mobile Messaging

Helferich Patent Licensing [NPE] filed suit against J.C. Penney, alleging that the J.C. Penney’s mobile programming updates infringe three patents related to wireless message transmission.  HPL has filed suit 18 times since 2008 against defendants including Asustek, Best Buy, Futurewei, HP, Huawei, NEC, Nokia, Palm, Panasonic, Sanyo, and ZTE. The patents-in-suit were issued to inventor Richard Helferich between July 2000 and March 2009, and were assigned to HPL between February 2008 and March 2011.  HPL claims to be the exclusive licensee of 25 US patents and 11 pending US applications related to delivering content to mobile communications devices.  HPL also claims to have licensed its portfolio to more than 90 companies including Amazon, Apple, Dell, eBay, HP, Microsoft, Motorola Mobility, Palm, and RIM.  12/23, Northern District of Illinois, 1:2011cv09143.
