Mobile Transformation [NPE] filed suit against CMI Marketing, alleging that CMI’s website infringes a patent related to displaying data of one type (such as video) while simultaneously playing advertising data of a second type (such as audio).  This is the first suit patent infringement suit initiated by Mobile Transformation.  The patent-in-suit originated with Adware LI, Inc., and was assigned to Penobscot Prospect LLC in November 2009.  Penobscot is the assignee of record according to the PTO.  The complaint identifies Mobile Transformation as the exclusive licensee of the patent-in-suit.  11/15, District of Delaware, 1:2011cv01123.
