DataTern Sues Asset Managment Software Providers

DataTern [NPE] filed two separate suits against Alpha Bay and Blazent, alleging that defendants’ cloud-based retail and asset management software solutions infringe a patent related to data mapping.  DataTern is a subsidiary of Amphion, and has filed nine prior suits since April 2008 against over 60 defendants including HP, Oracle, Sharp, and Sun. DataTern was subject to two actions for declaratory judgment filed by Microsoft and SAP, and Red Hat reportedly settled with DataTern for $4.2 million in 2008.  The patent-in-suit was assigned to DataTern by Firestar Software in 2007 and each of claims was reconfirmed during reexamination in 2009.  11/7, District of Massachusetts, 1:2011cv11970; 1:2011cv11975.
