University’s Optical Networking Campaign Sees Dueling Suits Over Newly Issued Patent

Ramot at Tel Aviv University Ltd., the “Business Engagement Center” of Tel Aviv University, has kicked off another round in its optical networking dispute with Cisco. The university’s latest complaint (2:22-cv-00168), filed in the Eastern District of Texas on May 24, accuses the company of infringing a single patent, the newest patent to issue in a family already asserted in this campaign, through the provision of networking transceiver modules and line cards as well as “major components of such modules”. That same day, Cisco and subsidiary Acacia Communications filed a declaratory judgment action (1:22-cv-00674) over the same patent in the District of Delaware. Prior cases from both parties remain on the dockets of both courts—with the university’s affirmative infringement actions stayed pending the outcome of ex parte reexaminations that have not gone in its favor so far.
