InterSystems filed an action for declaratory judgment against YYZ [NPE] concerning two YYZ patents felated to database applications. The complaint says YYZ sent a letter encouraging InterSystems to license the patents and claiming that other companies with similar products (such as IBM and Intel) have licensed them. According to the complaint, the parties discussed a potential license, but an agreement was not reached. The patents-in-suit were issued to inventors, Vincent Cyr and Kenneth Fritz, and were assigned to Promenix before being assigned to YYZ in 2006. Cyr is the managing partner of YYZ and the author of the letters sent to InterSystems.
