AMD and ATI filed an action for declaratory judgment against S3 Graphics and SONICblue over patents related to graphics processing units.  S3 Graphics was recently acquired by HTC.  The complaint in this case alleges that SONICblue sold ATI all of the patents-in-suit in March 2001.  In May 2010, however, S3 filed a complaint in the ITC over the patents-in-suit against Apple.  During the ITC investigation, which is still under review, S3 alleged that Apple’s accused products contain AMD/ATI GPUs.  AMD and ATI, in the present case, allege that ATI, not S3, is the rightful owner of the patents that S3 is asserting at the ITC.  AMD and ATI now seek injunctive relief in this district court action to make sure the ITC will not bar the importation of Apple products containing AMD/ATI GPUs into the United States.  10/13, District of Delaware, 1:2011cv00965.
