Realtek Resists District Court Stay to Await ITC Outcome

This past week saw Realtek Semiconductor open up another front in its litigation against AMD, asserting three semiconductor fabrication patents in a new Northern District of California complaint (5:22-cv-04769). Earlier this year, AMD sued Realtek, together with TCL, in the Eastern District of Texas and before the International Trade Commission (ITC), over five AMD patents in both venues (at least originally). There, TCL has sought and received a stay of the district court case to await the outcome before the ITC, which has become customary, but Realtek has not. In fact, Realtek opposes AMD’s request for a discretionary stay of the district court case.
