Acacia Subsidiary Sues Acer, ASUS, Fujitsu, and Toshiba

Optimum Power Solutions (OPS) [NPE] filed four separate suits against Acer, ASUS, Fujitsu, and Toshiba over a patent related to dynamic power management of solid state memory in laptop computers.  The patent-in-suit was assigned to Acacia Patent Acquisition by processor company Zilog in July 2009 before being assigned to OPS.  OPS has also filed separate suits against Dell, HP, Lenovo, Panasonic, and Sony after OPS’s case against those defendants was dismissed for misjoinder in light of the new America Invents Act.  Under the new Act, accused infringers can only be joined in a single action if the alleged infringement arises out of the same transaction or occurrence.  9/21, Central District of California, 8:2011cv01459; 8:2011cv01460; 8:2011cv01461; 8:2011cv01462.
