Plaintiff Returns to Litigation with an “Indirect Pointer System” Patent

The last litigation filed by UltimatePointer LLC, against Nintendo and a host of retailers of accessories for the Wii gaming system, ended when the Federal Circuit affirmed the Western District of Washington’s grant of summary judgment of noninfringement. That ruling was based, in part, on the construction of terms in the claims then in suit (“direct pointing device” and “handheld device”) to exclude “indirect” pointing devices. Now, UlitmatePointer has returned to court, this time targeting LG Electronics (LGE) (2:22-cv-00406) over the provision of LG’s Magic Remote television controllers and related TVs with a patent that just issued in the same family but is apparently directed to an “indirect pointer system”.
