Litigation Against Microsoft Now Stayed, ThroughPuter Sues Amazon

In early June, Western District of Washington Judge Barbara J. Rothstein denied a motion to stay in litigation filed by ThroughPuter, Inc. against Microsoft. However, in mid-August, a discovery dispute that the parties brought to Judge Rothstein’s attention “caused the Court to reexamine its Order denying the requested stay”. That second look led the court to conclude that “the PTAB’s resolution of Microsoft’s IPR petitions would simplify the issues and benefit the Court’s resolution of this case” after all. ThroughPuter has now filed a new case, this one in the Western District of Texas against Amazon (Amazon Web Services) (1:22-cv-01095), asserting two patents issuing since May, both within the same family in suit against Microsoft.
