Biometric Authentication Campaign Faces Motions to Stay, Except in West Texas

November 15, 2022

Charter Pacific Corporation Limited and its subsidiary CPC Patent Technologies Pty Ltd have filed an affirmative lawsuit against Assa Abloy (HID Global) (6:22-cv-01170) in the Western District of Texas as HID Global (together with other related entities) move to stay a declaratory judgment action that they had earlier filed against Charter Pacific and CPC in the District of Connecticut in light of certain inter partes review (IPR) proceedings. Also a defendant in this campaign, Apple has already won such a stay, after a successful fight to have its February 2021 case transferred away from the Western District of Texas to the Northern District of California, where Judge Edward J. Davila halted the litigation, first to await institution decisions, then extended the stay now that trials have been instituted.
