After Delaware Revelations, Backertop Discloses Only Litigation Counsel and MAVEXAR in Connection with New Suits

Two of Backertop Licensing LLC’s latest complaints, one against Anker (Fantasia Trading) (5:22-cv-02081) and the other against Exaktime Innovations (2:22-cv-08571), have been filed in the Central District of California. That district requires litigants to disclose anyone having a pecuniary interest in the outcome of the litigation, Backertop certifying on the day that it filed its cases there that nonparties Karthik K. Murthy (as “Lead Counsel for Plaintiff”) and Murphy Patent Law PLLC (as “Law Firm of Lead Counsel for Plaintiff”) have such an interest. One week later, however, Backertop Licensing refiled that certification adding another party: MAVEXAR LLC, as “Consulting Agent for Plaintiff”. The Backertop-MAVEXAR connection will be familiar to those following the “Series of Extraordinary Events” (December 2022) unfolding in the District of Delaware, but its disclosure here might raise a related question—namely, why Backertop excluded from both disclosures the LLC that its sole owner agreed under oath is to receive 49 percent of any proceeds from its litigation efforts.
