Number of New Delaware Cases Tied to IP Edge Tumbles—to Zero

Plaintiffs linked to Texas monetization firm IP Edge LLC—and there are a lot of them—have shifted their preferred venue for filing patent cases from the Eastern District of Texas before 2017’s TC Heartland decision on proper venue to the District of Delaware since. However, after the “Series of Extraordinary Events” unfolding in the courtroom of Delaware Chief Judge Colm F. Connolly following the imposition of his April 2022 standing orders regarding heightened disclosures for litigants in that courtroom, a shift in IP Edge’s filing preferences has emerged. The shift did not happen immediately, but it has been sudden and sharp—and as of October, it can be succinctly, and unsurprisingly, described as: avoid Delaware.
