Acacia and Transpacific IP Leave No Stone Unturned in Slingshot’s Suit over Failed Patent Deal

Questions abound about BlackBerry’s still-pending sale of its non-core patent assets to Catapult IP Innovations Inc.—a Delaware entity apparently tied to patent monetization professional York Eggleston—for $600M. This summer, BlackBerry announced that its exclusivity period with Catapult IP had ended, the would-be buyer having missed the May 2022 deadline by which it was to have secured the required funding commitments. An industry conference this week provided no updates on the BlackBerry transaction, but for those following a breach of contract matter in Delaware state court springing from a failed patent sale involving Eggleston’s Slingshot Technologies LLC, delays surrounding the BlackBerry transaction have begun to echo. Motions for summary judgment filed recently by the defendants in that suit reveal why.
