West Texas Patent Case Assignment Policy Remains Substantially Unchanged
On July 25, 2022, former Chief Judge Orlando L. Garcia posted a new policy regarding case assignments in the Western District of Texas. While plaintiffs could previously select District Judge Alan D. Albright by filing directly in the Waco Division, where he is the only district judge, the July order required that all patent cases filed there be randomly assigned among a group of 12 judges from throughout the district, including Judge Albright. Filing levels wobbled as a result, as parties weighed the effect of that order, with some wondering whether a change in the chief judge in West Texas, set for December 2022, might also change the case assignment policy. December 2022 has now come and gone, with an order handed down a couple of weeks ago clarifying that West Texas case assignment, with one tweak, will remain steady as it has gone.
