Top-Filer IP Edge Pumps the Brakes Everywhere

For the first time in seven years, a calendar month has passed without a single patent case filed, in any district court in the US, by a plaintiff with apparent ties to Texas monetization firm IP Edge LLC. The last new case from such a plaintiff landed in November 2022, as part of a pattern of filing an average of 50 suits per month that has held steady for years. Indeed, to find a gap analogous to this past December’s, one has to look all the way back to December 2015—and that pause likely was not a true standstill. Rather, it occurred on the calendar only because notable pleadings reforms took effect on the first of that month, seemingly prompting the monetization firm to pull forward its planned December filings (to avoid those reforms), since IP Edge-associated plaintiffs filed over 100 cases in November of that year, many of them during the 24 hours of November 30. Prior to December 2015, the query has to reach back to November 2014 to find a month without an IP Edge suit. Why December 2022, then, for such a recently unprecedented pause? The answer can likely be provided in one word: Delaware.
