Allegedly Revamped Streaming Standard in Crosshairs of Prior Plaintiff

B.S.D Crown Ltd (f/k/a Emblaze Ltd.) has returned to litigation, suing Amazon (Amazon Web Services, Twitch) (3:23-cv-00057) over the same patent that it, as Emblaze, previously asserted in separate cases filed against Apple and Microsoft. A Northern District of California jury returned a noninfringement verdict for Apple in July 2014 after a trial at which Emblaze reportedly sought over $500M in damages for the use of HTTP Live Streaming (HLS) in the streams of certain content providers (e.g., of the NFL and Major League Baseball), as well as in Apple Keynotes and iTunes Festival. The Federal Circuit affirmed the judgment entered based on that verdict in Apple’s favor. Now, B.S.D Crown accuses Amazon’s streaming services of infringement. The plaintiff pleads that the “HLS standard has changed since the Apple lawsuit”, to reduce video streaming latency, such that use of it now infringes B.S.D Crown’s asserted patent, further alleging that the use of the Dynamic Adaptive Streaming over HTTP (MPEG-DASH) standard also infringes.
