In July 2022, Health Tracker Systems LLC initiated its sole litigation campaign with suits against Fossil Group and Samsung in the Eastern District of Texas, followed by separate Southern District of New York cases against Capri Holdings (Michael Kors), Casio (Casio America), and Polar Electro later that month. The Delaware plaintiff has now expanded its campaign with a suit against Lenovo (1:23-cv-00093), this time in in the Western District of Texas. The plaintiff asserts a single patent generally related to detecting the physical movement of a human being or primate, measuring its intensity, and sending an “epoch feedback signal” to the user and/or “supervisor” if the “epoch intensity measurement” crosses a certain “threshold”. Lenovo is accused of infringement through the provision of smartwatches that support certain activity tracking functionalities.
