Personal Audio [NPE] filed suit against Apple over a patent related to playlist management. In July 2011, a Texas jury ordered Apple to pay Personal Audio $8 million in damages over claims from a different patent related to Apple’s iPod devices. During that case, Apple and Personal Audio entered into two stipulations expressly reserving newly released products for a second lawsuit, which Personal Audio filed against Apple in July 2011. The court, however, interpreted the $8 million judgment as a, “fully paid up license for all past and future sales of Apple products that incorporate the patented technology” and refused to allow the second case to continue.
