Pinn, Inc. has filed a new case against OnePlus (6:23-cv-00271) over the provision of certain OnePlus-series wireless earbuds. This suit was filed in the Western District of Texas instead of the Central District of California, where Pinn filed its prior litigation, against Alphabet (Google), Apple, and Samsung. Three patents were asserted there, with only one of those appearing in the new complaint. The trio of earlier cases each ended in a dismissal with prejudice, Apple’s on the eve of a second trial after a first saw the jury return notes to the court that led to a mistrial.
