Chicken Producers Claim Sysco’s “Sale of Lawsuits” to Lit Funder Burford Capital Runs Afoul of Champerty

Last month, the heated clash between food distributor Sysco and its litigation funder Burford Capital cooled, the parties ending their dispute over settlement authority in a group of price-fixing cases—and also attempting to swap a Burford affiliate in as the plaintiff. However, this week, a group of poultry producers raised concerns about the parties’ request to substitute a newly formed Burford affiliate for Sysco, citing the centuries-old champerty doctrine.
