Sky Technologies Sues Microsoft and Other Software Vendors

May 12, 2011

Sky Technologies, LLC [NPE] filed suit against Microsoft, Siemens, JDA Software and others over eight patents related to network based e-commerce negotiations. This is the seventh suit filed by Sky Technologies since 2003. Prior defendants have included HP, SAP, IBM, and Oracle.  In September 2010, Sky Technologies entered a patent licensing agreement with SAP, settling a suit originally filed by Sky in October 2006.  The suit against SAP also involved an appeal in which SAP unsuccessfully challenged Sky Technologies’ standing.  Ownership rights to the patents was transferred to Sky via a creditor after the assignee, TradeAccess, defaulted on loans.  According to the complaint in the current suit, Jeffrey Conklin founded both TradeAccess (also known as Ozro) and later founded Sky Technologies to buy back the patents from the creditor after the default.  Conklin is also the lead inventor named on the in-suit-patents. 5/11, District of Massachusetts, 1:2011cv10833.
