So far this year, Hyper Ice, Inc. (d/b/a Hyperice), together with its subsidiary Hyperice IP Subco, LLC, has sued Big 5, Costco, Emory Peak Wellness, Home Depot, Kohl’s, Walgreen, and Worldwide Golf Shops in the Western District of Texas; Cotsoco, Dacorm, Joicom, Macy’s, Musclegun, Therabody, ThreeSixty Group (MerchSource), and Toloco in the Central District of California; Arboleaf, CVS, Kroger, Lowe’s, and Target in the Eastern District of Texas; Bob and Brad in the District of Minnesota; and FKA Distributing in the Eastern District of Michigan. At issue in this campaign are a set of utility patents and a set of design patents, both broadly directed to certain percussive massagers.
