May 10, 2011-  The ITC issued a notice that Apple has satified the domestic industry requirement which had been challenged by defendants Nokia and HTC.  HTC and Nokia had argued that Apple had failed to provide the required market-context analysis that had been established by an ITC determination in another case in April in which the ITC Commission had declared, “the magnitude of the investment cannot be assessed without consideration of the nature and importance of the complainant’s activities to the patented products in the context of the marketplace or industry in question.”
