Micoba LLC, an affiliate of IP Edge LLC, has filed two new cases in the campaign that it began last December, asserting the same file-foldering patent against iHeartMedia (2:17-cv-00693) and Spotify (1:17-cv-01364). The accused products in the new complaints are the iHeartRadio Free Music & Radio and Spotify Music apps, respectively, with infringement allegations focusing on their automatic foldering of music files (e.g., by genre, artist, etc.). Each of the 11 first round cases were filed in the Eastern District of Texas before the US Supreme Court’s TC Heartland decision on proper venue in patent cases; the iHeartRadio complaint was also filed in the Eastern District, alleging that the defendant is incorporated there (and is therefore deemed to reside in the district), while the Spotify complaint was filed in Delaware, where it was incorporated.
