Accused of Pleading “Barebones” Infringement Allegations, OptiMorphix Files Three More

With its December cases against Akamai Technologies (1:24-cv-01336), Fortinet (1:24-cv-01418), and Meta Platforms (1:24-cv-01409), OptiMorphix, Inc. is now in active litigation against seven defendants, eight having already left this campaign. This plaintiff’s more recent complaints have all been filed in the District of Delaware, each over a subset of patents, received in April 2023, from a portfolio apparently “developed at Bytemobile and later Citrix”. In October, OptiMorphix sued Brightcove, hitting Intel, NVIDIA, and Salesforce (MuleSoft, Slack) in November. Brightcove has moved to dismiss the complaint against it for pleading inadequacies, arguing that the plaintiff’s “allegations are so untethered to the accused products in this case that it has made the same allegations against numerous other defendants by simply swapping out the defendant and product names”.
