Past Defendant Contesting Service by Mail, Helix Microinnovations Sues Two More
Helix Microinnovations LLC has filed an Eastern District of Texas complaint against Apollo Global Management (Lumileds Holding) (2:25-cv-00565) and a Western District of Texas complaint against NXP Semiconductors (NXP USA) (7:25-cv-00241), each targeting the use of the Chip-On-Glass (COG) fabrication process in the formation of their respective Chip-On-Board (COB) modules. Eastern District of Texas Judge Rodney Gilstrap presides over the only other live case in this campaign, against German defendant Micro-Hybrid Electronic, in which a motion to dismiss for improper service (attempted via registered mail into Germany via the Texas Secretary of State) has been fully briefed. The plaintiff has asked that the motion be denied, allowing it time to effect service under the Hague Convention or, in the alternative, to simply email papers to local counsel appearing to file the motion to dismiss.
