Jury Awards $12.5M to Empire Technology Development, as Exclusive Licensee of Two University of Texas Patents Tried
In a Friday verdict, an Eastern District of Texas jury has found infringed just one of three patent claims tried against Samsung, awarding Empire Technology Development LLC $12.5M as lump sum compensation. The plaintiff asserted two patents owned by the Board of Regents of The University of Texas System but for which it is allegedly the exclusive licensee under a June 2009 Master License Agreement (MLA) with an Intellectual Ventures LLC (IV) entity, the MLA assumed by Empire Technology Development in June 2017. Magistrate Judge Roy S. Payne recommended the denial of a Samsung motion challenging standing; Samsung has filed objections, but District Judge Rodney Gilstrap has yet to rule.
