Retail Mobile App Campaign Storms Texas Courts

One of Wolverine Barcode IP LLC’s first lawsuits, filed against CVS last November, was hardly a juggernaut given that Western District of Texas Judge David Counts dismissed it (without prejudice) for “want of prosecution”. Blink and one week later, the plaintiff filed a notice of dismissal (of the already-dismissed case) with prejudice. An answer has been filed in the other November 2024 suit, against Costco. Since then, Wolverine Barcode IP has filed additional cases targeting mobile apps provided by Albertson’s (3:25-cv-01448), Amazon (7:25-cv-00330), Best Buy (7:25-cv-00331), Maverick’s (d/b/a Inspire Brands) (Dunkin’ Brands) (7:25-cv-00334), McDonald’s (7:25-cv-00316), and Seven & I Holdings (7-Eleven) (7:25-cv-00207). Given the colossal proliferation of mobile apps interacting with QR codes, there is little mystique surrounding the number of defendants that might be forged into this campaign; i.e., it is no longshot to suggest that it could cannonball into a sizeable beast.
