IP Edge Affiliate Launches Customized Interface Campaign

Guild Forest LLC, an apparent affiliate of Texas monetization firm IP Edge LLC, has initiated a new litigation campaign, suing IFWE (1:18-cv-01483), Pinterest (1:18-cv-01480), Snap (1:18-cv-01481), Spotify (1:18-cv-01482), and Time (MySpace) (1:18-cv-01479) in the District of Delaware. The sole patent-in-suit generally relates to compiling and consulting user profiles to customize “an interface”, with infringement allegations focused on the use of user data for targeted advertising and analytics on the defendants’ social media platforms.

September Sees Three Defendants Exit, Four Others Enter, in PoC Campaign

Another apparent affiliate of monetization firm IP Edge LLC has expanded an existing litigation campaign. Last month saw dismissals in earlier Techno Licensing LLC cases, against Airbus, Telus, and Verizon, as well as a new suit filed against Telapex (Cellular South); so far this month, the NPE has sued Dillon Kane Group (1:18-cv-06505), NEC (3:18-cv-02559), Simoco EMEA (2:18-cv-00405), and Zebra Technologies (1:18-cv-06506) in various districts. Throughout this campaign, Techno Licensing has asserted a single patent generally related to push-to-talk (PTT) over cellular (PoC) service, with infringement allegations targeting devices that support PoC communications.

Server Performance Campaign Continues with a Second Case Filed in Georgia

One month after an apparent settlement ended the first case in its sole litigation campaign, Accelerated Memory Tech, LLC, an entity affiliated with Atlanta-based monetization firm IP Investments Group, LLC (d/b/a IPinvestments Group), has filed a second case, against Barracuda Networks (2:18-cv-00175), again in the Northern District of Georgia. The plaintiff accuses Barracuda Networks of infringing a single patent, generally related to improving server performance, through the provision of application delivery controllers for enterprise networks—namely, its Load Balancer ADC product lineup. On August 24, the suit between Accelerated Memory and Citrix was dismissed with prejudice after the filing of earlier documents suggesting settlement.

Digi Portal Expands Targeted Advertising Campaign

Digi Portal LLC has expanded its litigation campaign over a former Yahoo patent, generally related to delivering customized webpages to Internet users. New suits have been filed against Microsoft (LinkedIn) (1:18-cv-01484) and Quotient Technology (1:18-cv-01485) and come as the deadline to answer or otherwise respond to the complaint in the first case, filed against Twitter earlier this year, has been moved to late October. Infringement allegations focus on the defendants’ use of targeted advertising on their respective platforms.

Wireless Peripherals Campaign Adds Case in September, After Multiple Defendant Dismissals in August

Universal Transdata, LLC, an affiliate of IP Investments Group LLC (d/b/a IPinvestments Group), has added a suit against Lenovo (1:18-cv-04327) to its litigation campaign targeting wireless peripherals (i.e., keyboard, mouse, keyboard-mouse combination) connecting through USB wireless receivers. The NPE has asserted a single patent, received in April 2017 from Intellectual Ventures LLC (IV), against eight defendants, with 2018 cases against Deerbrook Electronics, PC Gear Head, Razer, and Tecknet Online each ending last month.

Court Filings Disclose IV’s Interest in IPVal Litigation

Earlier this year, RPX flagged an SEC filing by NPE Quest Patent Research Corporation (QPRC) that revealed a financial stake held by Intellectual Ventures LLC (IV) in QPRC’s litigation. A disclosure filed with the court this week in an IPValuation Partners LLC (d/b/a IPVal) case suggests that IV—which has assigned at least 80 US assets to IPVal to date—may have an interest in the success of additional NPE campaigns.

Federal Circuit Affirms PTAB Ruling Upholding Finjan Patent as NPE Reports Jump in Revenue

Another Finjan Holdings, Inc. patent has survived a validity challenge. On September 19, the Federal Circuit upheld a March 2017 decision in an inter partes review (IPR) filed by Palo Alto Networks, finding that a malware detection patent held by the publicly traded NPE is not invalid as obvious. The decision affirmed the PTAB’s holding that the asserted combinations of prior art did not disclose a key claim limitation related to the processing of data received over a network. It comes shortly after Finjan, buoyed by recent settlements in its ongoing litigation campaign, reported $82.3M in revenue for the first half of 2018, an increase of more than 200% over the same period last year.

Acacia, Under New Leadership, Adds Defendants to Semiconductor Testing Campaign

Acacia Research Corporation has not launched a new US litigation campaign since mid-2015, but one of its many 2014 campaigns has now come back to life. Acacia subsidiary In-Depth Test LLC has filed new lawsuits, one each against NXP Semiconductors (1:18-cv-01461) and Qorvo (1:18-cv-01462) over the single patent asserted, which is generally related to semiconductor testing. This recent activity follows multiple unsuccessful challenges to that patent through inter partes review (IPR), consideration of an Alice motion challenging the patent in existing district court cases, reopened after lengthy stays, and the approach of a claim construction hearing, in early October.

As Four Prior Defendants Exit Campaign, Checksum Sues Dell

Checksum Ventures LLC, one of several affiliated NPEs to assert former Nero AG patents this year, has added Dell (1:18-cv-06321) to its litigation campaign. The patent-in-suit generally relates to using checksums while storing data, with Dell accused of infringement through the provision of its EMC VNX Storage Systems, which Checksum Ventures alleges uses an SHA-1 hash value “for stored content on that storage system”. The prior four suits in this campaign have been voluntarily dismissed without prejudice, before the defendant has answered or otherwise responded, within weeks of each complaint’s filing.

August PTAB Activity Included IPRs Against Fortress NPEs, Among Other Prolific Filers

The Patent Trial and Appeal Board (PTAB) saw activity in August 2018 involving a variety of frequent litigants. This included petitions for inter partes review (IPR) filed against two NPEs controlled by Fortress Investment Group LLC, INVT SPE LLC and Uniloc 2017 LLC, the latter of which has in recent months cofiled a barrage of lawsuits with subsidiaries of Australian NPE Uniloc Corporation Pty. Limited (Uniloc). The PTAB also instituted trial in August for IPRs against Uniloc 2017 and some of its campaign coplaintiffs, and in an IPR against an NPE controlled by patent attorney Brian Yates, whose US litigation has waned as he pursues a new patent licensing initiative through his company iPEL, Inc. Finally, the PTAB issued final decisions in August for IPRs against Uniloc, Empire IP LLC, and Quarterhill Inc.
