Consolidated Transaction Processing LLC (CTP), an Equitable IP Corporation plaintiff, has followed up its late 2023 cases against Ace Hardware, IKEA, Mavis Tire Supply, OReilly Automotive, Reinalt-Thomas, and Walgreens and its early 2024 cases against Batteries Plus and Carvana with new suits filed separately against Eyemart Express (4:24-cv-00448), R.T.G. Furniture Group (4:24-cv-00450), Sally Beauty Supply (4:24-cv-00451), Steinhoff International (Mattress Firm) (4:24-cv-00449), The Childrens Place (4:24-cv-00447), and Tilly’s (4:24-cv-00453), all in the Eastern District of Texas. The asserted patents generally relate to using personal information to generate targeted advertisements, with the defendants accused of infringement through their respective e-commerce websites’ support for certain location-based advertisement tools.

Equitable IP’s Push Notification Campaign Nears 50 Defendants Sued

Push Data LLC, an entity associated with Equitable IP Corporation, has added a slew of defendants to its sole litigation campaign, suing Elliott Capital Advisors (Barnes & Noble, Nook Digital) (4:24-cv-00120), First Community Bancshares (4:24-cv-00128), First Watch Restaurants (4:24-cv-00129), Macy’s (4:24-cv-00121), Nekter Juice Bar (4:24-cv-00130), Office Depot (4:24-cv-00131), PacSun (4:24-cv-00123), PGA Tour (4:24-cv-00124), Progressive (4:24-cv-00125), and State Farm (4:24-cv-00126), all in the Eastern District of Texas. The four patents-in-suit, asserted in overlapping sets, generally relate to sending information to a mobile device based on user preference and location. The defendants are accused of infringement through the support of push notification features in their respective mobile apps.

Equitable IP Plaintiff Pushes Out Eight More Eastern District of Texas Complaints

After suing ASICS, American Eagle, Gartier (Zara), H&M, Kering (Gucci), Planet Fitness, and Zumiez this past October, Push Data LLC hit Citibank (4:23-cv-01117), Costco (4:23-cv-01119), Exxon Mobile (4:23-cv-01120), Kroger (4:23-cv-01121), Mahwah Bergen Retail (Lane Bryant) (4:23-cv-01122), Nordstrom (4:23-cv-01123), Rent-A-Center (4:23-cv-01124), and Wayfair (4:23-cv-01126), each in the Eastern District of Texas. Up to four patents generally related to sending information to a mobile device that is related to a user preference and also based on the user’s location are asserted, with infringement allegations throughout targeting the provision of mobile apps, websites, and/or desktop applications that support push notifications.

Equitable IP Resumes Video Surveillance Litigation

Anadex Data Communications LLC, an Equitable IP Corporation plaintiff, has filed separate Western District of Texas cases against Altex Electronics (1:23-cv-01416), Ravat Group (Amcrest Industries, Amcrest Technologies) (1:23-cv-01417), and Samsung (Samsung Electronics) (1:23-cv-01420). Throughout this campaign, begun back in March 2020, Anadex has taken aim at the provision of video surveillance systems with a single patent generally related to processing analog video frames.

Equitable IP Plaintiff Restarts Media Coding Campaign with Suit Against Cisco

Scale Video Coding LLC, an entity associated with Equitable IP Corporation, has revived its sole litigation campaign, initiated in October 2021 with Central District of California complaints against Brightcove, KDDI, Mitel Networks, NTT (NTT Cloud Communications US (d/b/a Arkadin), V-Cube, and Zoom. In a new Eastern District of Texas complaint, the plaintiff accuses Cisco (4:23-cv-00803) of infringing a single patent generally related to a “video router” that transmits a “layered video data stream” with a base layer and multiple enhancement layers to a video receiver device, where the base layer is transmitted along with a subset of the enhancement layers selected based on available bandwidth and the video processing capabilities of the receiver. Scale Video Coding targets the provision of products—including the Cisco Meeting Server, Web App, and Meeting Management platforms—that are compliant with the H.264 video compression standard and related scalable video coding (SVC) technology.

Number of Defendants in Mobile App Campaign Pushes Past 50

Communication Interface Technologies, LLC (CIT), a subsidiary of Equitable IP Corporation, keeps suing. The latest defendants are Adidas (4:23-cv-00720), Collinson Group (Priority Pass) (4:23-cv-00727), F21 OpCo (d/b/a Forever 21) (jointly owned by Authentic Brands, Simon Property, and Brookfield Property) (4:23-cv-00723), Hibbett Retail (City Gear) (4:23-cv-00722), Hyatt Hotels (4:23-cv-00724), Marriott International (4:23-cv-00725), OnePlus (4:23-cv-00726), Regis (Supercuts) (4:23-cv-00729), and Sport Clips (4:23-cv-00728), tagged over the provision of their various mobile apps. At issue are features for delivering push notifications from servers to mobile devices, these defendants joining those sued this past May—American Automobile Association (d/b/a AAA), AT&T, H&R Block, Honeywell, and Keller Williams Realty—in the Eastern District of Texas.

Consolidated Transaction Processing LLC (CTP), an Equitable IP Corporation plaintiff, has filed another round of complaints in the file-and-dismiss campaign that it launched in July 2016, suing retailers ARO Liquidation (f/k/a Aeropostale), Hudson’s Bay (Saks Fifth Avenue), Lost Arrow (Patagonia), LVMH (Sephora), Shoe Carnival, Tapestry, Target, The Container Store, Urban Outfitters, VF (Vans), and West Marine, each in the Northern District of Illinois. The two asserted patents generally relate to using personal information to generate targeted advertisements, with the defendants accused of infringement through their respective e-commerce websites’ support for certain location-based advertisement tools.

BMW and Mercedes-Benz Added to Equitable IP’s Automobile Campaign

Michigan Motor Technologies LLC (MMT), an entity associated with Equitable IP Corporation, has resumed its sole litigation campaign with suits against BMW (1:22-cv-03804) and Mercedes-Benz (1:22-cv-03957) in the Northern District of Illinois. The seven asserted patents generally relate to various aspects of motor mechanics (e.g., systems for controlling fuel injection, fuel rail pressure, power consumption, throttles, and valve timing). BMW is accused of infringement through the provision of automobiles that incorporate the BMW 2.0L I4 N20 engine; Mercedes-Benz, through automobiles that incorporate the M176, M177, and M178 engines, as well as electric vehicles with displays that show power consumption information.

Equitable IP Reups Virtual Immersion Campaign

The last case in the campaign of Virtual Immersion Technologies LLC (VIT) closed last fall, but the Equitable IP Corporation plaintiff has now resumed litigation with new suits filed against Accenture (2:22-cv-04513), CannonDesign Builders (2:22-cv-04514), Fluor (2:22-cv-04516), Johnson & Johnson (8:22-cv-01247), Safran (8:22-cv-01248), and Shell (2:22-cv-04517) in the Central District of California. A single patent is in suit. It generally relates to virtual reality entertainment systems, with infringement allegations continuing to target the use and/or provision of “virtual and augmented reality technologies and services” in multiple contexts, including marketing and training.
