IPVal’s Recog IP Reloads in E-Commerce Websites Campaign

IPValuation Partners LLC (d/b/a IPVal) plaintiff Recog IP LLC has added another round of suits in the campaign that it took over from fellow IPVal entities Recall Marketing LLC and Retrospection Marketing LLC in September 2021, suing Adidas (6:22-cv-01260)—which has since been voluntarily dismissed without prejudice—and Gap (6:22-cv-01261) in the Western District of Texas. The sole asserted patent generally relates to tracking and displaying information about the pages visited on a particular website (and then discarding that information upon departure), with the defendants accused of infringement through the provision of e-commerce websites that support features for displaying recently viewed items.

IPVal Revives E-Commerce Website Campaign Through Third Texas Plaintiff

IPValuation Partners LLC (d/b/a IPVal) plaintiff Recog IP LLC has taken over the campaign of fellow IPVal entities Retrospection Marketing LLC, which kicked litigation off in April 2016, and Recall Marketing LLC, which then took over in May 2018. The latest defendant is Dick’s Sporting Goods (6:21-cv-00977), sued in the Western District of Texas. Asserted is a single patent, originating with Siemens, generally related to tracking and displaying information about the pages visited on a particular website (and then discarding that information upon departure). Infringement allegations against Dick’s Sporting Goods mirror those against earlier defendants, focusing the “recently viewed items” feature of its e-commerce website.

IPVal Affiliate eCeipt Hits Best Buy and Others in Revival of Retail Receipt Campaign
eCeipt LLC, a Texas NPE affiliated with IP Valuation Partners LLC (IPVal), has resumed its retail receipt campaign, filing four new lawsuits against Ann (2:16-cv-01105), Best Buy (2:16-cv-01106), Caleres (2:16-cv-01111), and Recreational Equipment (2:16-cv-01112). These latest cases are eCeipt’s first new litigation since the August dismissal of its case against GNC Holdings (2:16-cv-00419), which followed the dismissal of all other suits in the campaign in January-March. The plaintiff’s newest complaints assert the same, single patent-in-campaign (8,643,875), which generally relates to point-of-sale (POS) kiosks that allow a customer to select a printed or emailed store receipt. Defendants are each accused of infringement through POS systems that offer both types of receipt.

IPVal Forms Texas NPEs, Transfers Patents, and Files Litigation, Most Recently Against HPE and Oracle
Amid a flurry of NPE creation and patent transfers, two affiliates of IP Valuation Partners LLC (IPVal) have added cases to campaigns launched earlier this year. Aurelian IP Management, LLC has filed suit against Fair Isaac (2:16-cv-01063), Hewlett Packard Enterprise (HPE) (2:16-cv-01064), and Oracle (2:16-cv-01065), accusing each of infringing a single patent (6,272,495) generally related to processing free-form data. The managing member of Aurelian IP is IPVal principal, Jonathan Szarzynski, whose colleague Adam Baumli is identified as the managing member of Retrospection Marketing LLC, the other affiliate that just added more cases, on the same day, to its own campaign. Retrospection Marketing filed suit against Best Buy (2:16-cv-01067), Kohl’s (2:16-cv-01068), and Wal-Mart (2:16-cv-01069), asserting the single patent-in-campaign (7,296,062), generally related to the display of information through a network, against the retailers’ e-commerce websites.

IPVal Acquires Patents, Forms Texas NPEs, Launches Campaigns, and Adds Portfolio Managers in the First Half of 2016
At the halfway point in 2016, at least five NPEs affiliated with the principals of patent monetization firm IP Valuation Partners LLC (IPVal), Adam Baumli, Jason Bourgeois, and Jonathan Szarzynski, have launched litigation. A new campaign filed this past week by ePt Records, LLC joins campaigns started earlier in the year by Aurelian IP Management, LLC; eHierarchy LLC; PositionTech LLC; and Retrospection Marketing LLC. Having added new portfolio managers to its team and new LLCs to its stable of Texas entities, several of which have recently received patent rights, it looks as if this year IPVal may surpass its seven campaigns of 2015.
