Ford Becomes Second Defendant, after Toyota, in WiLAN Campaign
Wi-LAN Inc. (WiLAN) subsidiary Collision Avoidance Technologies Inc. has filed a second suit asserting a single patent (6,268,803) generally related to a system that uses multiple sensors to detect the distance and location of objects near a vehicle. The new defendant is Ford, which is accused of infringement through the manufacture and sale of various Ford and Lincoln cars, sport utility vehicles (SUVs), minivans, and pickup trucks that offer Ford’s “Active Parking Assist” feature. Collision Avoidance filed the first case in this campaign, against Toyota, in late June 2016; little appears to have happened since then other than the August 2016 filing of Toyota’s answer, which alleges both that the court lacks subject matter jurisdiction because the right to sue for patent infringement was not conveyed to Collision Avoidance and that the ‘803 patent expired for intentional non-payment of maintenance fees on August 1, 2013.
