Status Icon Campaign Snags NEC

Callstat Solutions LLC has filed another suit in its latest litigation campaign, accusing NEC (6:21-cv-01255) of infringing a single patent generally related to “dynamically indicating a status of a communication system” through a graphical user interface. The NPE accuses NEC of infringement through the provision of the UC700 Desktop Client, with features for changing the color of a “status icon” based on a user’s availability at issue. The patent is among thousands assigned by Intellectual Ventures LLC (IV) to Hanger Solutions, LLC in December 2019.

Callstat Solutions Widens Two Campaigns, Launches New One

After an early September reboot of two earlier litigation campaigns and the start of a third, Callstat Solutions LLC has began a fourth, suing Sync.com (6:21-cv-00918) and Zoom Video Communications (1:21-cv-01314) over a single patent generally related to “dynamically indicating a status of a communication system” through a “graphical user interface”. The asset is one of thousands assigned by Intellectual Ventures LLC (IV) to Hanger Solutions, LLC in December 2019, as are the patents-in-suit in Callstat’s other three campaigns, two of which Callstat has just expanded as well: one to add a case against ZTE (6:21-cv-00919) and the second to sue Check Point Software (3:21-cv-02134) and McAfee (2:21-cv-00352).

June Efforts Having Hit Headwinds, Callstat Solutions Tries Again

This past June, the first two campaigns of Callstat Solutions LLC each got off to a rocky start. In both, the NPE asserted patents picked up from Intellectual Ventures LLC (IV) that had been invalidated under Alice in the past. The cases—one against Garmin, the others against Nordstrom and Xerox—were dismissed without prejudice within a couple of weeks. Now, Callstat has rebooted each of those campaigns, suing Boxer Parent (BMC Software) (6:21-cv-00911) in one and HP (6:21-cv-00912) in the other, both over different patents. The NPE has also opened a third campaign, this one targeting HTC (6:21-cv-00913) and Lenovo (Motorola Mobility) (6:21-cv-00914) with two other former IV patents.

Headwinds Seem to Be Facing Delaware NPE’s Suits over Former IV Patents

Garmin (6:21-cv-00630), Nordstrom (6:21-cv-00632), and Xerox (6:21-cv-00631) have been separately sued by new Delaware NPE Callstat Solutions LLC in the Western District of Texas. Each complaint asserts either one or two patents from a trio apparently received from Hanger Solutions, LLC, which picked them up in a large portfolio acquisition from Intellectual Ventures LLC (IV). Those three cases seem likely to face an early hurdle, however: prior invalidation under Alice of all claims from two of the three patents asserted.
